Welcome to RottenHOAs.com ("RottenHOAs," "we," "us," or "our"), which also does business as ("DBA") HOAReviewer.com. These Terms of Service ("Terms") govern your access to and use of RottenHOAs.com and HOAReviewer.com (together, the "Site" or "Sites"), including any content, functionality, and services offered on or through either domain. By accessing or using either Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. What RottenHOAs / HOAReviewer Is

RottenHOAs.com and HOAReviewer.com are operated as a single platform under a DBA relationship, allowing individuals to anonymously submit reviews and experiences related to homeowners associations (HOAs), HOA management companies, and related parties, without requiring an account or login. RottenHOAs.com collects reviews through Tally, a form platform that encrypts submitted data both in transit and at rest and complies with GDPR data protection standards. HOAReviewer.com is where submitted reviews are made live and publicly searchable, and also offers its own secure, native, on-site review submission form for reviews about HOAs and management companies. Regardless of which domain a review is submitted through, these Terms apply equally to both Sites.

2. User-Generated Content

All reviews, comments, ratings, and other content submitted to the Site ("User Content") are created and submitted by individual users, not by RottenHOAs. RottenHOAs does not write, verify, investigate, fact-check, edit for accuracy, or endorse any User Content. User Content reflects the personal opinions and experiences of the individual submitter, not the views of RottenHOAs. We do not guarantee the accuracy, completeness, or truthfulness of any review or other content posted on the Site. Because reviews are submitted anonymously, we generally cannot verify the identity of a reviewer or independently confirm the facts described in a review. By submitting content to the Site, you represent that, to the best of your knowledge, the content is truthful and based on your genuine personal experience.

3. Prohibited Content and Conduct

When submitting content, you agree not to post material that:

-Is knowingly false, defamatory, or misleading;

-Contains threats, harassment, or incitement to violence;

-Discloses private, personal, or identifying information about an individual without their consent (doxxing);Infringes on any third party's intellectual property or legal rights;

-Is unlawful, obscene, or violates any applicable law or regulation.

We reserve the right, but have no obligation, to remove or refuse to publish any content that we believe, in our sole discretion, violates these Terms.

4. Section 230 / Platform Status

RottenHOAs is a platform that hosts and displays content submitted by third-party users. We are not the "publisher" or "speaker" of User Content and, to the fullest extent permitted by applicable law (including Section 230 of the Communications Decency Act, 47 U.S.C. § 230), we are not liable for User Content posted by third parties, regardless of whether we have been notified of the content or its potential legal issues.

5. Content Disputes and Removal Requests

If you are an HOA, HOA management company, board member, vendor, or other party referenced in a review and believe that a specific review contains false statements of fact, violates these Terms, or should otherwise be reviewed, you may submit a request to [email protected] with:

-The specific review in question (URL or identifying details);

-A clear explanation of why you believe the content should be reviewed or removed;

-Any supporting information relevant to your request.

We will review such requests but do not guarantee removal of any content. Submitting a request does not obligate RottenHOAs to take any specific action, and any decision we make is at our sole discretion.

6. No Warranty

The Site and all content on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the fullest extent permitted by applicable law, RottenHOAs and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any User Content, even if advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless RottenHOAs and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) any content you submit; or (c) your violation of these Terms or applicable law.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles, unless otherwise required by applicable law.

Meet Our Founder

RottenHOAs.com was founded by Zachary Wallman, a Scottsdale, AZ-based entrepreneur with a background in early-stage startups and a family history deeply rooted in real estate.

Zachary didn't build this platform from the outside looking in — he built it after his own firsthand experience with an unaccountable, opaque HOA. That experience, combined with years working across consumer-facing startups, made the problem impossible to ignore.

What started as a place to vent has grown into a platform reshaping how homeowners, buyers, realtors, and real estate attorneys think about HOA accountability.
